These terms govern every quotation, booking, consignment note (LR/builty), portal account and tracking link issued by JK Express (“JK Express”). Placing a booking or handing over goods constitutes acceptance. Where a signed master agreement exists between JK Express and a customer, the master agreement prevails over these terms to the extent of any conflict.
1. Scope
JK Express acts as a carrier by road under the Carriage by Road Act, 2007 and operates as a registered Goods Transport Agency. Services include full truck load, part load, tanker and bulk, container and port movement, over-dimensional cargo, temperature-controlled transport, warehousing and distribution as described in the applicable quotation.
2. Bookings & quotations
Quotations are valid for the period stated (default 7 days) and are inclusive of fuel, tolls and driver allowances unless stated otherwise. Rates assume the declared weight, dimensions, material and loading/unloading arrangements; material differences may be re-rated. Placement slots are confirmed in writing; cancellation after a vehicle has been dispatched to the pickup point attracts the cancellation charge stated in the quotation.
3. Consignor obligations
The consignor must declare the goods accurately, provide valid tax invoices and e-way bills, pack and label goods suitably for road transport, disclose hazardous properties and supply the required documentation, and ensure loading and unloading within the free time. Undeclared hazardous, prohibited or contraband goods are the consignor's sole responsibility and may be refused, unloaded or reported to authorities.
4. Transit, delivery & detention
Transit times are commitments subject to force majeure, road closures, statutory checks and events beyond JK Express's control; delays are notified through the tracking link and WhatsApp. Delivery is complete on signature or OTP confirmation by the consignee recorded on the e-POD. Detention is calculated from geofence timestamps at the loading and unloading locations after the free time stated in the quotation and is visible on the portal.
5. Liability & insurance
JK Express's liability for loss or damage is governed by the Carriage by Road Act, 2007 and the Rules thereunder, limited to the declared value stated on the LR unless a higher value has been declared and accepted with the applicable premium. Transit insurance is arranged for every consignment up to the declared value; claims must be notified within 7 days of delivery (or scheduled delivery) with the delivery remarks, photographs and the accident evidence pack where applicable. JK Express is not liable for consequential loss, market fluctuation or delays caused by incomplete documentation.
6. Payment
GST e-invoices are raised within 24 hours of POD and are payable within the credit period stated in the quotation (default 30 days). JK Express may exercise a lien over goods for unpaid freight. Disputes on an invoice must be raised within 10 days through the portal; undisputed portions remain payable on the due date. Interest at 18% p.a. applies to overdue amounts.
7. Portal & tracking use
Portal accounts are personal to named users of the customer; credentials must not be shared. Tracking links may be forwarded to consignees and other parties with an interest in the consignment but not published or scraped. JK Express may suspend access for misuse or security reasons. Data handling is described in the Privacy Policy.
8. Governing law
These terms are governed by the laws of India. Courts at Surat, Gujarat have exclusive jurisdiction, subject to arbitration by a sole arbitrator seated at Surat under the Arbitration and Conciliation Act, 1996 where the disputed amount exceeds ₹5,00,000. Notices may be sent to jkexpres@gmail.com.
